Does the person over whom guardianship is sought have to know that a petition for guardianship was filed?
The person who’s the subject of a guardianship proceeding is entitled to know that a guardianship has been filed. They are entitled to all of their due process rights. They’re entitled to receive a copy of the petition determining capacity that was filed against them.
