How is a guardianship proceeding initiated?
A guardianship proceeding is initiated by the filing of the petition determining capacity. This will normally be accompanied by petition to appoint a guardian. When these petitions are filed, the court will appoint a three member examining committee to exam the alleged incapacitated person and to report back to the court. It will also assign an attorney to represent the alleged incapacitated person.
